Verdict: Kenneth Moreno, left, and Franklin Mata were cleared of rape at New York Supreme Court on Thursday
‘She should go to jail for this,’ Mrs Moreno said, claiming the woman was motivated by a $57million lawsuit filed against the City of New York.
‘She had two days to make up this story with her lawyer friends before she went to the hospital,’ she told the New York Post.
Mrs Moreno said her husband was an 18-year veteran trusted by ‘everyone’ at the NYPD and would often be asked to take home partners’ girlfriends when they were drunk.
Her comments follow the jurors’ admission that there were holes in the testimonies of the woman and the two police officers.
The verdict has puzzled and outraged some observers, with hundreds of people attending a protest event near the court on Friday (see video).
The New York Post today slammed it as ‘one of the most shocking verdicts in the city’s history’.
The jury, made up of five women and seven men, acquitted the pair who were accused of raping the woman in her flat after they were being called to help her home from a night out.
Angry: Hundreds of people gathered outside New York Supreme Court to protest about the verdict
Seven-week trial: Kenneth Moreno, left, was accused of raping the woman at her New York apartment while colleague Franklin Mata, right, stood watch, after they helped her home from a night out in December 2008
Juror Richard Schimenti said: ‘No one is ever going to know what happened in that apartment because (the victim) was blacked out.
‘The prosecution really failed to prove their case,’ he told the New York Post. ‘There was no evidence of a rape – except that she said it.’
He said the woman’s testimony was seemingly ‘artificial’ and manufactured by the prosecution.
Juror Eric Casiano said it was a case of measuring up different testimonies and there was reasonable doubt that the rape did not happen.
Moreno and Mata were contesting 15 charges such as rape, burglary and fudging records to cover their tracks. Both have been fired from the NYPD following the incident.
The two police officers were called out to help the woman into her flat by the cab driver who was taking her home – because she was drunk, throwing up and he wanted her out of his taxi.
Moreno insisted the woman told him ‘I’m not drunk – I’m just sick’ when she was sitting in the back seat of a taxi after the cops had been called by the driver to get the woman out of his cab.
The two then took the 29-year-old woman back to her flat, where she said she was raped by Moreno.
Moreno denied the rape but admitted being in her bed – claiming he was too ‘embarrassed’ to tell Mata about it, who he says was asleep on the woman’s sofa at the time.
The rape was alleged to have happened on the fourth visit made by the police officers to the flat.
The woman is also suing New York City for $57million, which led defence lawyers to label her a ‘gold-digger’.
Mata’s lawyer Edward Mandery said: ‘By bringing these allegations, she thinks she’ll never have to work another day in her life. $57million is a heck of a lot of money.’
Evidence: The woman described in court how she remembered being raped on the night in December 2008
As the long-running ‘rape cops’ trial concluded last week, the pair spoke of their relief outside New York Supreme Court on Thursday.
Both officers were acquitted of all charges except official misconduct for going back to the woman’s apartment three times without telling their supervisors. They could still be jailed for this next month.
‘It was just a roller coaster. I hope everything works out for her. I wish her no harm’
They were found not guilty of other charges including rape, burglary and falsifying business records.
Speaking outside court, Officer Kenneth Moreno said: ‘I thought she made the whole thing up.’
He added prosecutors should have dropped the case after no DNA evidence was found on the woman.
‘It didn’t end with the DNA not being found,’ Moreno said. ‘They just continued their investigation. It was just a roller coaster. I hope everything works out for her. I wish her no harm.’
‘I want to finally get on with my life. I’ve been innocent from day one’
Mata said outside court that he was ‘glad’ the trial was over. ‘I want to finally get on with my life,’ he said. ‘I’ve been innocent from day one.’
‘I believe in my heart of hearts justice was served,’ Moreno’s lawyer Joseph Tacopina said outside after the verdict.
The trial has been graphic at times and much of it has hinged on the officers’ word against the woman’s – as there was no DNA evidence linking the cops to a sexual assault.
The woman, 29, who cannot be identified for legal reasons, talked openly about her memories of being sexually assaulted and defence lawyer Chad Seigel was earlier rebuked by the judge for likening a woman’s genitals to a ‘snapping Venus fly trap’.
The officers insisted no sex happened but they were charged with rape under the theory that the woman was so drunk she could not give her consent.
